During the first Ducks game of the season I met a number of friends at The Ranch just before the game started. During the first quarter I stood up (as did many others at my table) to cheer. When I sat down my chair had flipped away from me and when I sat down I landed on my rear. As I was being lifted up by my girl friend and friend, our waitress came over and stated she saw the entire incident and that the chair leg was broken and flipped back on it’s own, and that it wasn’t my fault…”it was the broken chair that flipped back on it’s own accord. You didn’t have a chance..I tried to warn you!“ She immediately apologized and offered me another chair of which another friend had already gotten me, and she then put the defective chair on the table between the two bathrooms.
Later that night I experienced pain in my lower back and before leaving The Ranch I followed up with a report of the incident to another employee. Following the event I hurt for several days and because I didn’t want to cause any problems with an establishment that I enjoyed frequenting I waited to see if I was just bruised (as it turns out it’s not just a bruise)….hoping the pain would subside. After several days and sleepless nights with discomfort I went back to The Ranch and asked the bartender to have the owner(s) contact me so that we could discuss the incident. (I never intended to sue anyone and thought that I would use my insurance to cover the bulk of any medical attention needed, hoping that maybe The Ranch would just cover the out-of-pocket deductibles or portions not covered by my insurance.) Several more days went by and again I didn’t hear back from The Ranch so I went back in again a couple more times requesting the owner(s) contact me. I didn’t hear back from anyone until the third Ducks game. While I was at The Ranch viewing the game an employee told me that one of the owners was on the phone and wanted to speak to me.
What happened next shocked (and upset) me. The owner didn’t even ask if I was okay, but immediately started accusing me of being drunk and knocking the chair over. As I stated before it was early in the first quarter of the game, so I had maybe a couple of beers. The owner told me that they reviewed the tape, but wouldn’t offer me an opportunity to see it, and although their employee stated at the time of the incident stated (in front of several witnesses) that it was a broken chair that caused the mishap…the owner replied ,”that’s not what happened and we don’t help drunks who fall on the floor in our bar”. “You didn’t follow procedures, and there’s nothing we can do for you!” Incidentally, where are the procedures for injured patrons posted?
The bottom line is that as an (ex) regular patron at their business they were happy to take the several hundred of dollars that my friends and I spend at their establishment monthly, but when it comes to really caring about a patron who gets injured, they turn their backs.
